Account Suspension & Termination

Hostwinds outlines the suspension and termination of any Hostwinds account in this document. All accounts can and will be suspended or terminated per these conditions.

What is a suspension?

Suspensions can apply to any service or account from Hostwinds. A halt is placed on a suspended service's use until the issue is resolved. Hostwinds recommends opening a ticket and speaking with a frontline agent as soon as possible to expedite the solution to the problem that forced the suspension.

Hostwinds may suspend client access to Services, including all files, content, and domain name registrations, without notice:

  • All services billed hourly must be paid for within one (1) day of their due date or risk suspension.
  • A suspension can occur as the result of a chargeback, which can additionally result in termination.

What is a Termination?

Terminations can apply to any service or account from Hostwinds. A terminated service loses all data and services that previously would have existed in the service being terminated. A terminated account loses all data and services that previously would have lived in the Hostwinds account.

Reasons for termination

Hostwinds will terminate client access to Services, including deletion or confiscation of all files, content, and domain name registrations, without notice, if:

  1. Clients fail to pay any fees due.
  2. Clients violate the terms and conditions of this Agreement.
  3. Client conduct may harm Hostwinds or others, cause Hostwinds or others to incur liability, or disrupt Hostwinds's business operations (as determined by Hostwinds in its sole discretion).
  4. Clients are abusive toward Hostwinds's staff in any manner.
  5. For any lawful reason, including complying with applicable laws or as otherwise specified in Hostwinds' terms of service agreement.

Hostwinds does not refund fees paid in advance of termination. In addition, clients are obligated to pay all charges & fees accrued before their account termination. In addition, upon the termination of the services for any reason, user content, user websites, and other data will be deleted.

A quick breakdown of timelines

Payment Timing and Suspension and Termination

  • Payment for all non-hourly services is due and payable before their use.
  • All non-hourly service with an outstanding invoice for more than fourteen (14) days is subject to termination.
  • Payment for all hourly services is due and payable on the first (1st) of every month to use the service for the previous month.
  • All services billed hourly must be paid for within one (1) day of their due date or risk suspension. Any hourly service that is unpaid beyond ten (10) days will be subject to termination.
  • Additionally, a suspension can occur as the result of a chargeback, which can result in termination.

Chargebacks and Disputes

If Hostwinds is notified that a chargeback or other payment dispute is filed, the account is placed automatically on hold.

A hold will suspend all active services connected to the account. In addition, these services are at risk of termination should the dispute not be immediately resolved.

To resolve a chargeback, clients must:

  1. Provide proof of ownership for the payment method used
  2. Repay all disputed transaction(s)
  3. Pay a two hundred fifty dollar ($250) penalty fee per disputed transaction.

Failure to do so results in termination of service(s) on the account. In addition, the account remains on hold. This prevents any new orders or purchases from being completed.

Non-hourly services with invoices that are delinquent for more than fourteen (14) days may be terminated. Services billed on hourly rates must be paid for within one (1) day of their due date or risk suspension. Any hourly service that is unpaid beyond ten (10) days will be terminated.

Additionally, a suspension can happen as the result of a chargeback, which can result in termination.
